Settlement Agreements

Settlement Agreements Solicitors in London and Essex

Whether you are an employer who is negotiating a termination package with staff members or an employee who has been made redundant or unfairly dismissed, a settlement agreement is the answer to resolving the majority of legal issues. We can help you to negotiate a satisfactory resolution to your case without the need to resort expensive and lengthy employment tribunal proceedings.

The purpose of a settlement agreement – formerly known as a compromise agreement – is to legally formalise the termination package of an employee. The effect of the settlement agreement is that the employee waives any rights to bring employment-related claims against their employer in exchange for a termination or compensation payment. Employment-related claims include claims for unfair and wrongful dismissal, statutory redundancy, unpaid wages, notice pay, holiday pay and more.

To ensure the settlement agreement is legally valid, it is essential it is drafted carefully to satisfy all legal requirements. One of the requirements is that the employee obtains independent legal advice from a relevant adviser before they sign the agreement. The adviser – usually a solicitor – must sign an adviser’s certificate to confirm that such independent advice has been given.

We understand the need to comply with tight deadlines – often insisted by employers. We will normally be able to advise an employee at short notice and part of our advisory role will be to indicate whether or not the offer being made is a favourable one.

We recommend that you contact us to discuss your case with us. All conversations will be treated in strict confidence.

Our unique selling point is that we understand what clients want from their lawyers. We will manage your case proactively, with careful attention to detail while never losing sight of the bigger picture.

We offer a range of pricing options and will be happy to discuss these with you. As a client-centred law firm, we will be transparent with you about our pricing and actively manage these in line with our agreements.

How we can help with Settlement Agreements matters

We will give you expert advice and representation from the start-to-finish of your matter, while making sure that you understand the various stages along the way. We can guide you through matters including:

  • Advising whether or not the employer has offered a good deal. If an employer, we can help you formulate deal terms and advise on whether or not such terms are likely to be accepted.
  • If a potential dispute is running alongside the settlement discussions, we can advise you on the dispute (behind the scenes if you prefer) to help to put yourself in the strongest position from a negotiating perspective. This can lead to more favourable settlements.
